CONDITIONS OF PARTICIPATION FOR THE DEMO SCORE SOCIAL MEDIA COMPETITION

These conditions of participation refer to the competition of the company Toukana Interactive GmbH, Eitelstr. 35,10317 Berlin, Germany, e-mail contact: privacy@toukana.com  (hereinafter referred to as "Organizer"). Participation in the competition shall be governed exclusively by these conditions of participation. The competition is in no way connected to Valve or Discord and is in no way organized or supported by Valve or Discord. Participants will not assert any claims against the aforementioned platform operators in connection with the competition.

1. Duration of the competition

The duration of the competition is from June 9, 2025 to June 16 at 19 CET. During this period, users will have the opportunity to take partin the competition online.

2. Procedure of the competition

Participation takes place exclusively in the SteamCommunity Hub and Discord.

To participate:

• In the Steam Community Hub: Comment on the competition post and attach a screenshot of your Expedition level score.
• On our Discord server: Comment on the competition post and attach a screenshot of your Expedition level score.

Participation shall be only possible within the participation period. Entries received after the closing date will not be considered for the selection of winners.

Only one submitted registration per participant will be entered into the competition. Each participant can only win once and a win on oneplatform excludes a win on another platform. It is strictly forbidden to use multiple accounts to increase the chances of winning.

Participation in the competition is free of charge.

3. Eligible participants

Natural persons who are resident in the European Union, Switzerland, Norway, Liechtenstein, Iceland, Great Britain, Monaco, Vatican City, San Marino and have reached the age of 18 areeligible to participate. Participation is not limited to customers of the Organizer and is not dependent onthe purchase of goods or services. Persons who have not reached theage of 18 by the closing date are expressly excluded from the competition.

If participants have limited legal capacity, the consent of their legal representative is required.

Employees of the Organizer and its subsidiaries or affiliated companies andtheir relatives are not eligible to participate.

In addition, the Organizer reserves the right to exclude persons from participation at its own discretion if there are justified reasons,for example:

(a)in the event of manipulation in connection with access to orexecution of the competition, in particular in the form of editing screenshots,

(b)in the event of breaches of these conditions of participation,

(c)in the event of unfair trading or

(d)in the event of false or misleading information in connection with participation in the competition.

The participant declares that he/she will only take part in thecompetition if all conditions of participation are met.

4. Winning, notification and transmission of theprize

You can win:

Community Hub: A winner(s) will be drawn from all participants. One prize includes - a Star Birds Steam key, redeemable on Steam. (Playable only from Early Access release of the game).

Discord: A winner(s) will be drawn from all participants. One prize includes -a Star Birds Steam key, redeemable on Steam. (Playable only from Early Access release of the game).

The winners will be determined promptly after the closing date, but nolater than 2 days after the closing date.

If you win, you will be contacted via direct message from the officialToukana channel on Steam and Discord. If there is no response to the winning notification within 72 hours, a new person will be selected. Automated entries will be excluded from participation.

Inthe case of digital keys, they will be sent by direct message on therespective platform. An exchange or cash payment of the prize is not possible.

5. Premature termination of the competition

The Organizer reserves the right to cancel orterminate the competition at any time without prior notice andwithout giving reasons. The Organizer will make use of this option inparticular if, for technical or legal reasons, the proper executionof the competition cannot be guaranteed.

Insuch cases, the participant has no claims whatsoever.

6. Data protection
‍

As part of the competition, the user names of theparticipants are collected on the respective social media platforms.This data will only be collected for the purposes of the competitionand will then be deleted - with the exception of the winners. Thewinners assure that the personal details provided by them, inparticular any first name and surname details, are truthful andcorrect.

Alldata, with the exception of the winners' data, will be deleted nolater than 30 days after the end of the competition. The name anduser name of the winners will be used for the purpose of processingthe competition and as proof of fulfillment and will be kept for amaximum of the statutory retention periods for business letters. Thelegal basis for this is Art. 6 para. 1 lit. b) and c) GDPR. There is no right of objection unless the participant withdraws participationin accordance with section 7). 7. Withdrawal
‍

Participants are free to delete theirparticipation data at any time by sending a revocation to privacy@toukana.comand thus withdraw fromparticipation. With regard to the deletion of data from Steam or Discord, the respective operators are responsible for requestingdeletion.

8. Additional conditions
‍

Each participant in this competition agrees thattheir name or username may be published on Steam or Discord as thewinner. The indication of the real name is not mandatory and purely voluntary.

The winners grant the Organizer the right to use their screenshots in the context of self-promotion, including reporting on the competition andto promote the game " Star Birds ", perpetually and worldwide without further remuneration in all electronic and printmedia, in particular on social media platforms and in video streams , and own advertising material as well as at trade fairs or other events. The Organizer may request written confirmation of thetransfer of rights from the winners before handing over the prizes.

The Organizer's competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.

Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation.
